On December 9 and 10, 2011, a seminar on labor dispatch jointly organized by the All-China Federation of Trade Unions (ACFTU) and the Bureau for Workers' Activities (ACTRAV) of the International Labour Organization (ILO), was held in Beijing. Jiang Guangping, Secretary of the Secretariat of the ACFTU, and Dan Cunniah, Director of the ACTRAV of the ILO, attended the seminar and delivered speeches. A total of more than 30 people attended the seminar, including experts from the ILO and China, and representatives from trade unions and trade union colleges from all over the country.
The seminar was held against the backdrop of the increasingly complex global economy and the worsening employment issues. Director Dan Cunniah presented a report titled "Current Global Situation of Labor Dispatch and Unstable Employment" at the meeting. He pointed out that unstable employment is growing globally and all countries need to continuously revise laws and regulations in accordance with relevant conventions of the ILO to comprehensively cover all workers, including dispatch workers. Therefore, trade unions should leverage their organizational strength to protect the rights and benefits of different types of workers through collective bargaining. Mr. Linton, an expert from the General Labour Federation of Belgium, introduced the current situation of EU labor dispatch and unstable employment, as well as the basic experiences and issues in the implementation of EU regulations. Mr. Rakhwan, Director of the Bureau for Workers' Activities of the ILO for the Asia-Pacific region, delivered a keynote speech titled "Unstable Employment and the Labor Market". Mr. Wang Zhoubo, Deputy Director of the Labor Movement Research Institute of the ACFTU, introduced the current situation and issues of labor dispatch in China.
Professor Jiang Ying from the Law School of the China University of Labor Relations (CULR) was invited to attend the meeting and delivered a keynote speech titled "Review and Reconstruction of the Legal System of Labor Dispatch in China". In the report, Professor Jiang Ying introduced the provisions of China's Labor Contract Law regarding labor dispatch, and analyzed the reasons for the prosperous development of labor dispatch in China after the implementation of the Labor Contract Law. She pointed out that it is the unbalanced regulation of the law that led to the abnormal development of labor dispatch. She also proposed some suggestions on the future legal pathways and legal recommendations for regulating labor dispatch in China.
